People keep making the argument that there was someone behind the wheel? Regardless of what "mode" the car was in, it cannot be legally classified as "self driving" anymore than cruise control can be. Whether or not the DRIVER is at fault has not yet been determined, however, I sincerely doubt and hope that any investigation will ignore the fact that there was a driver behind the wheel on the basis the car had self driving capabilities.
