Portions are available for some uses, you're over simplifying.
Finally... in that case, the user is responsible for using the AI to duplicate the work in any appreciable form. It must be manipulated to do so, it won't just distribute the work.
This is no different (in principle) from users of peer to peer networks sharing content. The network enables a broad activity. The users committed infringement.
