Please point to images that are copied entirely by AI and posted elsewhere. That would be theft. Copying a style is not.
All the AI is doing is an automated version of what I would do if I studied all of van Gogh's paintings and created a new piece in the same style. If I did that, I could even sell it, no? But, when an AI learns from someone, it's theft?
They also did get permission from the original author. When an author posts an image publicly, they are inviting the public to look at it. It's like trying to claim privacy while standing in public: There is well established legal (and logical) precedent that you do not have an expectation to privacy when standing in a public space.
If the data collection bots went behind a paywall, as long as the creator actually paid then it's ALSO not theft, because once I buy something I can use it, right? I couldn't copy it, but they're not (see above).
There is just no stealing involved by any definition. Nobody is losing anything, nobody broke into a home or database to get images they weren't entitled to. Artistic style is not copyrightable. Look at how many animated movies copied Pixar's style, or even Disney's. People do this all the time and they always have. It's not suddenly wrong when a neural network does the same thing just because it does it faster and at scale.
