But will a judge be persuaded by lawyers for OpenAI claiming "the reconstruction is probabilistic and non-deterministic", when the NYT can present hundreds of examples of ChatGPT producing entire articles verbatim, and show that a non-trivial amount of people are using LLMs in this way to bypass paywalls? The relevant question is whether such infringing reproductions harms the market for NYT's copyrighted works, not the technical details of how that material is (or is not) stored or retrieved by the model.
