I genuinely don't understand why people use this argument. Just because something is technically, barely legal doesn't make it right or defendable. It's also well known that legislation catches up very slowly with the evolution of technology, it can take many years for the legislation to be changed to reflect what's good for the citizens when it comes to that technology. For example, pornographic deepfakes are illegal in few places in the world, doesn't make them morally not horrible, it's just that lawmakers are slow in catching up on how harmful they are and in figuring out how to combat it. Either way, we still know it's stealing, and there's still enough grounds for people to sue (which is what Disney is doing right now), but unfortunately most artists don't have the money for it, that's how AI companies get away with it.
