You are also not supposed to use FSD in the dark. The manual clearly states that "Visibility is critical for Full Self-Driving (Supervised) to operate. Low visibility, such as low light or poor weather conditions (rain, snow, direct sun, fog, etc.) can significantly degrade performance." I don't even use Autopilot at night. I barely use it at all. Not only that, but its painfully obvious that the driver was NOT paying attention at all based on reaction distance.
Respectfully... this was 110% his fault.
