It's still scraping data without permission. Does not change that fact. Didn't think he was too negative on the idea of AI Art generally if used well. Just what you said people misusing it. And that should be looked at. I experimented with AI Art as well for 3D Art, not very useful yet but very cool tech. Still should be looked at legally just like any other industry (music etc)
