For starters there is the actual AI, which alone (without a Data set) can't produce any images
When you add a trained dataset then the AI can start creating images based off captions from the dataset,
Even if you remove all copyright material from the stability ai dataset, private individuals like you or me can train our own datasets with any image we downloaded from the internet. (Which is actually where the Samdoesart DataSet is from, ["images someone downloaded and made a dataset from"] )
There is no way to enforce whether someone violates any copyright law or not, and StabilityAI the company cannot be held liable
