Since there is no definition of what is and is not transformative, every case would need to be evaluated by itself.
Most cases would easily be won against the music industry if people thought it would be worth going to court over a single video.

I'm not that familiar with the US laws but I'm fairly certain there's no such thing as "consenting to likeness".
The second you upload an image to the internet that image is public domain unless you copyrighted it.
If they had any chance of actually fighting this in court with actual laws they would do it. They wouldn't go beating around the bush trying to make new laws, and "target the money".
This is the main argument you can't beat, every time someone tries to "fight" against Deepfakes the lawyers tell them they will never win.
Unless you know something all the lawyers in the past 10 years combined don't.
