Datasets now are used in the same way as how a human goes to a museum to get inspired, it doesn't actually use the artists' work.
Lots of misinformation going on about how it "copies" art, when that's not the case. This is how Stable Diffusion works.
It's no different than a child prodigy, so no one can sue it.
