I think current copy right laws are pretty clear already as far as judging if a work is distinct enough. It’s the same thing as if you paid someone to copy another artists style, depending on how similar those are you’d have a case. Just like if you asked an AI art generator to make you an image replicating something. E.g if you asked Dall E 2 to make you a Disney style mouse to sell on a T-shirt versus asking it to make you a Mickey Mouse. One would be fine, the other would get you a cease and desist.
