The images were appropriated for scientific research into machine learning. That is fair use under US copyright law.
If they do sue and manage get a judgement or settlement-- I read Stabilty AI is worth $100million. Even if they extract every last penny of that. The database is over 5Billion images. If 4Billion are copyrighted, after lawyers get paid, they would get a penny or two per image. Stock photo conglomerates may get some pocket money to ride off into the sunset with, but artists like Sam won't get a cup of coffee. Stable Diffusion will still exist. AI companies will likely leave for China or Russia and the US economy misses out on being the home of the next industrial and military revolution. It's not always worth it to sue.
