You are completely and utterly wrong about the point 2, because the first dataset for AI image generating originated in Europe and it was open source and it was based on ONLY images which were in PUBLIC DOMAIN. Americans: "We're gonna rip off everything, entire internet, muhahaha!" The problem is that you are stealing someone's intellectual property to make commercial product (generate 10-20 images per day, if you want more - pay subscription). The problem is treating everything on the internet as public domain. AT THE SAME TIME, you company and your AI is NOT in public domain. People in general wouldn't be upset that much if AI companies used only images which are in public domain for AI image generators and being fully transparent about it. Example: you draw or create something, other person will ask you: "Can I use it for....", so you have control over what you did, what you created. American AI companies just PLUNDERED EVERYTHING without asking anyone anything and treating all the copyrighted material and intellectual property as public domain. Your argument is that AI will not recreate 100% what xy artist did. It's not about that, it's about STEALING AND PLUNDERING someone's work for dataset without asking anyone anything. The point is that all those CEO's and programmers and everyone who was involved in plundering intellectual property should be trialed and in jail. Police, FBI to break into their offices and confiscate everything and look into what material was used in dataset. If you ripped off and plundered intellectual property and copyrighted material for your datasets: you go to jail. IT'S THAT SIMPLE. Your company is shut down and you go into jail. If they used public domain images only, you don't have the case for it.
