Level 5 means everywhere in all conditions. Waymo is geofenced and therefore level 4, and an extremely limited level 4 at that. Tesla FSD is currently capable of level 3 in nearly all conditions and locations but is currently deployed as level 2. A policy change to allow level 3 operation is imminent (by end of year) and will be deployed via over the air update. Since Tesla is racking up FSD miles an order of magnitude faster than everyone else combined, and because it operates everywhere (freeways and city and coutry roads, not geofenced and not dependent on pre-mapping), Tesla will be the first to level 5.
