IMO that would be a bar I wouldn't want to set - in terms of requiring it be non-copyrighted works, since you'd kill off being able to have people explicitly allow you to use their work if they choose (or simplicity, through licenses like creative commons), since those are still "copyrighted works."
Basically, using copyright STATUS alone is nonsensical, IMO.
