Yes and the car enabled him to be negligent even after it kicked him off for being negligent. That's the same as me taking a weapon from you, setting it down beside you and then trying to claim "well I took the weapon from them". Also don't even get me started on how stupidly defective by design these cars and their "automated" driving are.
