Well, no - you've not established how you'd be able to ban it, if that reason would legally hold up, nor supported why actions would at all be appropriate - not to mention that open source models exist, and both open and non-open-source models exist outside of the US... also, how would you identify without false positives AI generated works?
It really isn't "simple as that," that's IMO far from simple in any sense of the word.
