"You" (general you), making AI art, would not be able to copyright it. The people who originally made the art are the ones that have the rights to it. Because the AI is a machine and generates by essentially copying and pasting, it would be similar to copying and pasting off of Wikipedia and trying to claim you wrote that. Even if you changed the order of things around and such, it wouldn't matter if it looks different, you still wouldn't have the rights and you could still get sued.
If you use an AI art generator where all the artists have given permissions and such, this isn't a problem. But the ones I know of are stealing art, which means people using them would be vulnerable to being sued. Now, I don't think that's likely in your case, which is what most people will probably do. And I doubt anyone cares if someone generates an AI piece for personal use or anything like that. But if you're like some of these people and trying to sell art claiming it as your own, you could definitely get in trouble if caught.
The main reason it isn't happening more is because it's hard to trace. Individual artists would have to find a random person elsewhere on the internet using pieces of their art. And then that individual artist would have to have the means/will to sue, etc. Most cases would be beyond what the average person would want to deal with even if they're in the right. And, even if they're in the right (which they are legally), there's no saying the judge presiding over the case would understand what it was about. It's always a risk. However, let's say you published a book and sold millions of copies, and it turns out your cover is AI-generated. The artist of that art would be able to go after you for using it without permission because they have the rights to it and you don't. People hoping to "make if big" by relying on AI to copy and paste pieces of art together for them are putting themselves at great risk if they DO somehow make it big. Sort of in the same line as tracing.
For example, imagine if Shad was using the art generators to make Disney-like characters to sell. Now that a big company is in the mix, would he get away with it or would he be sued into oblivion for using their art?
