@nottiification One difference here might be that a crowd moving around could be considered a very minor difference, making the differentiation in output negligible in different photographs of the same scene, or prompt. The different songs you get with AI music services with the same prompt are very different from each other, so much so that in my experience it is clear that a different songwriter could have created the other version. With such a wide variance, it would seem that the degree of control over the output could be a relevant point to argue.
Another difference to consider with photography is that the scene being photographed is most likely not a copyright protected piece of intellectual property. AI music companies are scraping copyright protected music for AI to train on, and at this point it seems there can be little doubt that AI music generated by Suno and Udio is largely (or entirely) assembled from varying sized bits of Master Recordings, which are protected intellectual property in and of themselves. Photographers don't normally take pictures of other photographs, or pieces of other photographs, and claim them as their own.
