The thing is, one is owned by corporations, and the laws for that are different than the laws for our brains, since using it for products does not count for free use. Free use applies to criticism, comedy, research, etc. If it was free use it would be free and completely without monetization. But it isn't, you can pay for AI services, which can count for copyright infrengement.
