@consistent1 This is a genuinely good response and I appreciate the effort you put into it. You're right that training data has market value and that companies benefited from it, the emergence of data licensing deals proves that. I'm not arguing they owe nothing.
But the "feature not bug" framing is speculation about intent. The over-representation emerges from internet distribution, not deliberate curation, nobody at these companies sat down and said "repeat Harry Potter more to signal importance." That's why it manifests as overfitting, which degrades the model, rather than as optimal weighting.
Your Gilmour analogy actually cuts the other way: musicians do spend years studying masters note-for-note, absorbing their phrasing through extensive repetition, without paying royalties for the learning. That's always been legal. The question has always been about outputs, not inputs.
"The learning itself is the violation" would be a dramatic expansion of copyright, and a dangerous one. If consuming content to learn patterns from it becomes a potential violation, that's a principle that wouldn't stop at AI. As I've said elsewhere in these comments it's hard to argue that a computer doing what a human does when consuming content should have different standards applied, which means you risk making all learning from copyrighted material suspect. That's not a road we want to go down, and courts have consistently declined to take it.
