Because nobody predicted this. But the governments move fast to make this illegal, with the USA, UK, and EU all moving towards regulating this technology and making new rules to make AI training on copyrighted works illegal without permission.

The concept of fair use has nothing to do with data extraction, except when the data extracted contains copyrighted data(and even then, only in countries that have fair use as a legal concept)
