Its not the act of training it on the copyright material that is illegal, otherwise we humans learning from it would be illegal. Its the AI regurgitating it back to users word for word verbatim that is illegal. The AI has to know how to transform the material enough to not infringe the copyright, just like how kids do research papers by reading and citing sources
