oh this case has already been litigated by the monkey who took a selfie. only humans can hold copyright, so the photo is public domain, not owned by the owner of the camera. this guy gets copyright to the prompt itself because that's his creative work, but the output is not created by a human so it can't be copyrighted.
the more interesting case i feel are these ai assistants in photoshop, if you draw but use substantial generative ai assistance, how much can you use before it's more machine output than human and loses copyright protection?
