Not sure if I caught the point, but AI variations to the art work should have to have license or appropriate a share of the proceeds to the original artist or subject of the photography. If you sold the work of art, you should have to compensate the owner of said work of art. Shouldn't be too expensive, but a practical aspect of making or purchasing art is that you own the image. You can then sell the image to be used commercially.
