I 99% blame the driver. There are sooo many videos out there of people literally reclined and sleeping at the driver's seat of a Tesla. The Tesla cult is like any other cults, full of idiots, who truly believe that Elon is Jesus and that autopilot is completely autopilot. Quick fact, Tesla has been sued numerous times by multiple crashed Tesla owners who blame autopilot didn't work... Tesla has NEVER lost a single case, because in fine print it states that it is not 100%, and drivers are fully responsible. 1% I blame Tesla for not putting in safeguards, or at least un-defeatable safeguards. Many other cars, if it doesn't sense your hands on the wheel, it'll beep at you and turn off any automatous features, some even have eye trackers to see if you're dosing off or have your eyes closed. How come you are able to fully sleep in a Tesla? I have this issue too, as a human, every time I follow a bike, it is harder to gauge distance, bikes are so skinny it's like I was driving with one eye, I almost always have to brake extra hard at the end cuz I thought the bike was further. One thing I do do as a rider is swerve in lane when traffic stops on the highway to try and get the attention of the driver behind me, I also installed signal lights with red tail lights around them because it's easier to gauge distance when there are two lights on each side rather than 1 single tail light in the middle
