Your counterpoint to "AI takes inspiration from references just like artists do" unmoving. The process of taking inspiration from a wide variety of sources and using a data set is at least analogous in my mind, only difference is the process in AI is quantifiable. The only thing it can't use is life experience. I think at the end of the day the lack of life experience will be the death nail, but it won't be for legal reasons. AI art, at the moment at least, still has an uncanny valley aesthetic to it. No soul. But little in our society has soul any more, so unless we're going full Butlerian Jihad, which you've said you're not in your next point, I am unmoved.
