At the rate new games come out, it is inevitable more and more will use AI generated art. Copyright law will only apply to the AAA games s.t. only the deepest pockets will come out the least scathed. The rest of the indi community will embrace AI-assisted content creation but AAA won't want to play whack-a-mole. We should stop asking if it is legal and start asking what we're going to do about it. There is no stopping neither humans nor AI from "learning from" your original content, nor from them creating derivative work. We need to make adversarial that can automatically identify it.
