People use artworks of others to train themselves all the time. And it's not illegal in most cases. Using something as an inspiration is tots legal, and usually there is a judge who decides whether or not the art was copied from yours. And they do that depending on how much visual information was taken. In case of AI, that's pretty easy to see. AI uses each piece of training info depending on weights. And weights can be stated by a human operator. This way is not perfect for sure, but it should do the trick. I guess the job can even be done by enother AI: if the art has a copyright, it's being used less, if it doesn't it's used more. Sounds pretty easy, doesn't it?)
