I think your theory about that taillight has high chance to be accurate. Wish the team at Tesla too figured this out. Now having said that I wanna add few things to the facts that you stated that no longer holds correct. 1. Modern LIDAR tech is no longer huge/costly and they are already being incorporated into some cars. So, Tesla not adding LIDAR is not due to cost savings. 2. Germany lost that Autopilot case on account of the actual definition of Autopilot(Think of planes) being an assisting feature and not complete autonomous. 3. Tesla cameras do see at night. In fact most cameras(including our phone cameras) see at night as they can see into infrared, in fact all the cameras have infrared filters to restrict them from seeing into it. 4. Even considering everything, the Tesla autopilot and ADAS and autonomy feature in other cars are still a lot safer in multitude of scenarios, some of which are captured in data and some that are not, even your adjusted graph shows that it's safer in most scenarios. Humans are getting lot more distracted lately due to mobile phones and the increased number of accidents show that and autonomy will be the real savior.
