The argument about "AI training too" is such a hoax. I am amazed at how sane people continue to bring it up with a straight face. WHO CARES how an algorithm works! People have rights including, rights to their creative results, not because we know how their brain work, or how we call it, but because we differ HUMANS from everything else. Making a misleading name for something is not enough to justify anything you want.
