I think a better solution to opting in is putting requirements on companies once they reach a certain level of popularity to ensure that exact replicas can't be made and that it can only use artist styles. Also require every image to have an immutable metatag that people can verify if its human or AI made. And, of course, any reasonable attempt to impersonate the artist by making a replica website would face legal consequences, though I'm pretty sure that's already against the law.
The problem with opting in is that without good data, ai will be useless and since most artists probably wouldn't opt in, they'd be too lousy and would essentially kill ai.
If you require tags and backend work to ensure it only references styles, which many actually do, then I don't see how artist and AI can't co-exist. It'll actually make real art more valuable if we're inundated with cheap art and real art is rare.
