Tough call. Looks like both people are to blame. It is a classic example of 2 people not paying attention at precisely the same time. There is a low probability of it happening, but it happens.
Uber appears to me to be a shady outfit. Licensed Taxi Drivers are still better than Uber drivers and the self driving technologies.
