As with most things in life, when it's used for commercial purposes the fair use argument typically doesn't apply.
Researchers look up info, extensively cite their sources and typically present the accumulated info to the community at large without profit.
What OpenAI is doing here is essentially taking other people's work, compiling it into a virtual textbook and using that to train their AI "models", AKA Students. Or, looked at another way, the AI models are essentially populating their own internal database with copies of other people's content. Unlike a human who's memory isn't an exact copy of the original content, the AI agent can pull of the exact content on demand. They are, quite literally, making copies of the original work.
