Forget about how the image is made. If you see an artwork used commercially that resembles your own work, then take action, doesn't matter who, or what made it. If it's not copying you, then let it be. AI doesn't generate new images by doing an image search, cutting out pieces of existing artwork and pasting it together. The AI learns from the images, understanding them, and formulating it's own rules about how to draw, just like a human would learn. Learning from publicly available images on Instagram is not copyright infringement. However like a well trained artist, AI can be used to create something wholly original, never seen before or it can be used to mimic existing artworks, and existing art styles. So the image generated MAY infringe copyright. If someone uses AI to copy your work then go after that person, don't go after the AI companies. That's the equivalent of going after Microsoft because someone used a computer to copy your work.
