You know, I think you maybe changed my mind on this debate. It's reasonable to ask artists if they want to opt in, and pay them for material used to train the AI.
AI artists currently get around the claim of 'copyright infringement' by doing stuff 'in the style of' specific artists. Like you can generate a "Sam-like" image and say "these eyes weren't directly lifted from any image by Sam", or "this background isn't the same as any specific background he made". And I used to think like that... "well, since it's not directly copied, the artist can't claim any ownership and therefore deserves nothing".
But those eyes and background wouldn't exist without Sam's input images, and those are supposed to be protected, and someone else is getting paid based on those protected input materials. So whether it's a 100% copy or not, I think legally it would fall under a "derivative work".
