The fact that so many of these ai companies in so many of these high profile lawsuits saying that if they actually have to respect the copyright of what other people made it would ruin their entire business practice says a lot about the ai companies and why they would have a vested interest in saying it doesn't apply. One of the main reasons that we have copyright is to protect the intellectual property holders from their works being stolen, used without permission or causing a financial loss to the copyright holder. What the training process for ai is is taking the work of other people without their consent and trying to use that to make money for themselves, you could argue fair use, but fair use actually requires you to be transformative, however that's not what they are using it for, what ai does is it tries to mimic the work it's been trained on, so if someone has copyrighted work, someone prompts ai on a similar topic and it produces pretty much the copywrited work, and then that person goes on and tries to use it as their own, if a person did that that would be copyright infringement and or plagiarism, just because you add an step of obfuscation into the mix doesn't change that
