The problem here not a failure of AI per se. AI is only as good as the data you give it. The problem is that we actually don't currently have access to all the relevant data points needed to make such predictions. My guess is that predicting recidivism is at least as complicated as predicting the weather 2 months in advance to a high degree of accuracy. Sure, a lot has to do with the person's psychological makeup (and even that can be fairly uncertain - not all psychopaths are criminals). But a lot also has to do with unforeseen events and opportunities (or lack thereof) in a person's life.
