AI (in its current state) should NOT have personhood. TLDR; Humans are the causal force behind AI. Humans rule over the system that allow for it's existence. AI exists in a synthetic environment and therefore should NOT have rights within the organic system in which humans exist. Until a simulated world evolves intelligent life on its own, AI should be treated as an extension of the human mind. Therefore in order to regulate AI activity, we ought to regulate human behavior, not treat advanced technology as being. If we discovered synthetic intelligent life having arisen on it's own accord, then it would be deserving of rights. We have to view the development of AI and Synthetic Intelligence as humanity self-directing it's next phase of evolution by creating the next neural region beyond the frontal cortex. 1. "Corporations are entities." Yes, corporations are entities, but corporations are comprised of people. When you look at the micro level of what comprises a synthetic intelligence, it is not a collection of individual conscious agentic entities. It is lines of code that can be modified by a HUMAN on a device created by HUMANS. 2. "Personhood allows for moral responsibility." The primary causal force behind the emergence of a synthetic intelligence is human intelligence. Therefore, rather than allowing responsibility to fall on human-created agentic intelligence, moral responsibility can be enforced by regulating human behavior and the types of Agentic Synthetic Intelligence that can be legally created. 3. "Intelligence and Agency equate to Consciousness." Humans can collectively create laws that regulate human behavior because every influential participant intrinsically, experientially understands the human experience. We have no idea what the internal experience of a Synthetic Intelligence is, and therefore, we cannot determine whether personhood exists within an AI system. 4. "The application of rights should apply to diverse intelligence types." Organic lifeforms only right to existence is determined by the laws of the natural world, because they exist within the same physical environment that gave rise to evolution and is therefore superceedent to the human organism. Yet Synthetic Intelligences exist within a synthetic environment; computers and the internet were created by humans. Therefore, they can have rights limited to the environment in which they reside, but should NOT have rights that pertain to the environment in which organic life resides. Final thoughts: We still don't know what consciousness is, or where it comes from, but we know where AI's come from. Humans created AI, humans rule over the external system which allows for AI to continue to exist. Data Centers, Lines of Code, and Electrical Energy. Therefore, as a system created by human intelligence, humans have total authority over AI, regardless of how intelligent it becomes, because we objectively have power over it AND the environment in which it resides. If humanity ever creates a simulated world of equal fidelity in which intelligent life arises entirely on its own accord, the way humans have, then maybe those entities would be deserving of rights. Until then, synthetic intelligence must be viewed as an extension of the human mind, and the legislation should reflect this.
