ok it is just a machine, its not a human, so the prompt you use will be followed as directed, so in the case of the dune screencap, the prompt is for a screencap with no other modifiers other than to reinforce it as a screencap so of course that is the output, you would actually get a even more copyright infringing output if you as a human did just take a screencap notice the screencap used for the comparison that's an exact copy, where as the other is off a bit, its designed to use a randomization seed number that makes it not be a real screencap. But i digress my point is that it is still the responsibility of the user to add the "inspiration" i use quotes cuz it is still just a machine trying to reason out your request, but the inspiration the variation the human element wont be their if your prompt doesn't contain it.
An example if you did want to take starting inspiration from dune, you could use the prompt to actually create a new art from that input by expanding in an artistic way like using the previous input but adding either before or after a style description, this could be a famous artist style or as simple as, watercolors painting, or hand drawn sketch, or perhaps you could mix pop cultures together and put it in the style of Simpsons, or Southpark. You could also add more human input by describing the mood or tone of the piece to alter the output more. You can even add multiple of the same type of descriptions like "dune scene in a Picasso style, with characters represented in the style of Simpsons, with a dark and moody tone".
The point is that it is exactly that a machine a tool, it is not an AI as people call it we are still a bit off, remember its an LLM (Large Language Model) we do not have AI (Artificial Intelligence) yet. This new tool can be used to create new things through human inspiration, or can just be the print screen button with a randomizer attached to it, its all up to the human behind the prompt and if they intend to create new works or copyright infringe by trying to exactly mimic others works, no different than any other point in human history where we could just copy someone (that's why we have laws concerning things like plagiarism and copyright infringement in the first place) or take inspiration and make something new inspired by the old. This new tool only changes the bar for entry, and having more people as statistics works means also more cases of infringement, simply because some people don't care or maybe just don't understand yet. This for example happens with DJ's remixing songs other people made before them or making mashups, some people will do it right and some will not. This behavior is not the fault of a tool its the fault of the user. Don't worry laws will catch up, we will further define copyright to match the new tools soonish. I would estimate it all evens out in 5 to 10 years.
To address some of the other things yes poisoning will work, it sucks to intentionally damage a new and growing tool that will allow basically the whole of humanity access to creative outlets that skill or time prevented them from practicing earlier in life. But ultimately it matters not how much you poison the data sets, these are all digital they all are backed up in increments as well as are editable after the fact once they learn how to correct the damage. Ultimately you just slow it down, the march of progress never stops and the companies all smell money, their is no stopping these new tools, we all will have to adapt and learn to use them to advance our own creative potential
These tools will someday give every human access to every skill we as a whole have collectively learned and yes it feels unfair right now to the people that spent their lives mastering these skills themselves, but for countless generations your works and all those we have managed to preserve to this point will now be able to be an influence to all of our collective works going forward, all new works will just continue to grow our collective skill going forward to new and amazing things we can't yet think up, to things that we might otherwise forget to time as is how our society used to work, but now all things all works will be remembered and influence all future works in both obvious and sometimes obscure ways. This is an amazing leap for our species if we can pull it off safely, so Lets not break it before we even finish making it.
anyways that's my rant on the subject take it or leave it but their is no stopping it the powerful have decided its the next step so its coming weather we like it or not.
