AI prompters thinking they are artists is ridiculous, but it is art, just not copyrightable, and depending on your point of view, arguably stolen. Not being copyrightable is the most important aspect of the lawsuit. The company sells access to a digital tool as a service, and no one owns the output legally. They will argue that the criminality lies in the person who tries to use X IP outside of the scope of the input-output machine, and laws already exist for those criminal actors and that crime.
