The driver pressed the accelerator pedal while rummaging on the floor - not watching the road. 1. automatic driving didn't disconnect and automatic brake didn't activate.
2. Auto pilot should deactivate.
Then in both cases the driver problem. Pressing accelerator in auto pilot is to avoid early braking.
