I think the main difference on the 2nd controversy is that humans take inspiration, meaning that while the art they made is inspired by other artists, they still put their own take into it. There's still an element they put in there that makes the artwork unique and original.
Whereas AI is literally just a machine-generated input. I'd personally say it's stealing because other than the new concept from the prompt, there is no inspiration, they don't have their own style, it's just a copy.
In a way, it's like tracing in the art community. While it's okay to do it for practice, claiming it as your own or using it to profit without the original artist's consent or credit is just bad.
