I feel that the main difference between the music industry and art community is in how the different forms of media are controlled and shared. Record labels already distribute content through relationships built by legal contracts and do everything possible to protect that IP. Artists who post art on Instagram, deviant art, and other platforms don't have the same protections. In fact, let's take a look at Instagram. Legally Instagram doesn't own any photos or artwork that you post. But their terms and conditions specifically state that they can legally sub-license your work that's been posted to their platform. Go ahead and Google it! Unfortunately, it's not no much legal loopholes that these AI platforms are using to build their datasets. Don't underestimate the amount of money Instagram and other platforms would be missing out on if they chose not to legally license out your artwork that you've provided to them!
