There’s precedent and no, AI “art” is not protected by copyright. For kind of the same reason that famous monkey wasn’t recognized as the author of the selfie it took. Also, if AI art was protected under copyright, and we asked two AIs trained on the same database to produce something based on the same criteria and they did basically the same thing, would we consider one to be plagiarism? Not even talking about the creative process, it is basically impossible to legislate on AI ownership of a creation.
By the way, nfts aren’t protected under copyright either.
