I think the quintessential problem in your legislation is the right of ownership to the image. In the US, the right of a picture is always given to the one TAKING the picture while in France (and other European countries) the right is first given to the one IN the picture THEN to the photographer. If someone takes a picture of me in the streets (say a paparazzi if I'm a celebrity) and I don't want it to be published I can block the publication or sue from damage if it has been published already. That's how most celebrities earn millions here. But if I'm reeeeeally pissed I can take it too criminal court where the photographer and the published risk veeeeery long prison sentences as publishing a picture of someone without their consent is considered voyeurism and is a criminal offense. It almost never happens because that would ruin a perfectly good money stream for most celebrities but I remember it's the choice made the Royal Family with the pictures of Diana car crash and body and those NEVER surfaced in France ! Of course, same goes for your likeness, if a random brand used my image on there packaging I could, yes, sue for millions in damages but I could technically put there entire management team in jail for decades ! I think AI generated porn will obviously fall under this law and in the shoes of a French victim of it I would make sure to have all the makers of fake porn about me condemned to long harsh years in one of France's very decrepit prisons with an international arrest warrant running on their name !!!
