The EU AI Act points to Article 4 Directive 790/2019 which allows for commercial use of ML on copyrighted data as long as there are opt-outs. The EU probably wants copyrightholders to be able to opt-out. There is NO law that would allow to sue for damages. 3:06 is wrong here.
