This is likely going to be an unpopular opinion, but I think its important, so here goes...
First, I am truly sorry for any artists that are affected by the new algorithms that are being used to generate images. However, this conversation needs to be about IP and copyright laws, not just about artists, because the LLMs that are being used to generate images do many other things besides generating images, and will continue to be developed into new tech that are unrelated to art. ChatGPT is an example of that.
The thing is that IP and copyright doesnt protect artists, it protects large companies. If you are an artist that can afford legal battles with large corporations, youre not an artist, youre a personal marketing firm. IP doesnt protect us, it protects large corporations (period.).
So that means that it isnt about the legalities of how the data was scraped. It is about the ethics, sure, but it is NOT about whether its legal or not, because legal is relative to wealth and always has been, in fact, it may have well been legal to use the images that were used to train these models. Why was it legal? Because of the interests of the wealthy.
If we agree that this is about ethics over legality, then let me ask you... where was this outrage when companies started to develop self driving cars? Many, many more people stand to lose jobs if that tech is ever finished than artists ever will.
I ask you to take a moment to think about what will happen to people that arent wealthy, maybe people in the global south, or in a community next to yours that cant afford to pay for SaaS subscriptions and eat, and pay rent. As AI tools are developed and become increasingly more powerful, they will give larger and larger competitive advantages to the people who have access to them over those who do not. So if we allow these technologies to be gate-kept by money and capital, then we will be creating a capitalist dystopia, where being an artist wont even be a thing, unless you are painting the portraits of the leaders of the economic slave revolution.
Lets gain some perspective and recognize that this fight isnt about protecting the IP rights of artists, it is about aboliching the IP rights of the large corporations that on the backs of so many other technologies developed by humanity before them are now developing new technologies that will be used to further global wealth inequality. This isnt about us artists, it is about the intersections of capitalism and technological development.
I hope this serves at least one person to see this issue in a broader context.
