On a very basic level any form of "copyright theft" is not theft because to copy anothers work is not to deprive them of said work thus it cannot be classified as theft. What is really being debated is weather or not copyright should be enforced on some level to incentivize creation and innovation to improve society. Regulating AI art essentially artificially limits potential access to the benefits of art for the consumer; because, it increases barriers to entry such as money to commission work. This hurts the majority to the benefit of a small portion of the population who want to make art as a job. If original art is truly better let people vote with thier wallet rather than force them to commission work if they don't want to make it themselves.
