I don’t trust the American legal system, so this could go either way, regardless of what is right. But one argument that resonates with me, is “why are photographs, copyrighted work?”
As I understand it, when photography was invented, artist used the same arguments they’re using against AI right now. When you take a picture, machine is doing all the work. A toddler can take a picture by accident. you can take a picture and there’s a nonzero chance that picture is good enough.
And you didn’t make any of the things in the picture. You didn’t make the sky or the buildings or the model in front of you.
But if you take a picture with your phone right now, you own the copyright of that picture.
And you could argue it took less effort than writing a prompt on midjourney.
And you could argue that the engineering behind your phones camera is as complicated as the one in the AI. A machine did the heavy lifting of your photograph. A machine you didn’t build.
A good picture requires that the photographer has a good eye. But so does choosing a picture from 1000 of generated a images that your prompt outputs. (yet, that doesn’t matter because you don’t need to have a good photograph to own the copyright of the photo you took.)
So if the legality of taking pictures is president, I don’t see why AI generated images should not be copyrighted by the person who prompted them.
